DEFINITIONS
– “Text Messaging Service” – SMS, includes any situation or agreement in which ECO – Eco finance sends one or more text messages regarding Info-product services.
– User, is any individual – aged 18 (eighteen) years or more, sole holder and bearer of a valid telephone number registered in Brazil – with any of the operators authorized by ANATEL – Agência Nacional de Telecomunicações, provided by the same in our “ QUIZ”.
– “Opt-In” refers to registering, subscribing, requesting, agreeing and consenting to the receipt of one or more SMS – Text Messaging Service, from our team.
– ECO – Eco Finança, means the portal that manages the SMS – Text Messaging Service, with the contents of Info-products.
TERMS
We maintain the “unique” relationship with our USERS, therefore, these terms are conditioned to the USER’s waiver of composing any CLASS ACTION, even if the USER disagrees in part or in full with these terms, we will present the ARBITRATION solution (Law n. 9,307 of 1996) antecedent to any judicial solution.
REQUIREMENT
By registering for our “QUIZ”, clicking on “Opt-In”, you affirm that you agree with all the terms and conditions contained in this SMS Term of Use – Text Messaging Service, Privacy Policy and General Terms of Use . In addition, he declares to be the holder, subscriber and sole owner of the telephone number provided at the time of registration, authorizing the receipt of SMS – Text Messaging Service and stating that he is 18 (eighteen) years old or older.
OPERATORS
The SMS – Text Message Service, with Info-product content is available for Telecommunications Operators registered with ANATEL – National Telecommunications Agency, in Brazil, for example: TIM, OI, Claro, Vivo, Nextel, CTBC among others.
STOP RECEIVING MESSAGES
To ensure transparency in the offer of content with info-products through SMS – Text Message Service, we provide an indirect trigger activated with the word “STOP”, in this way, you will no longer receive the SMS – Text Message Service . However, if you return to the “QUIZ” and re-register your phone number, “IT WILL ACTIVATE” the receipt of new messages.
TECHNOLOGIES USED
We use the technologies of the companies: TWILIO.INC and AKNA, to send out SMS – Text Messaging Service.
DATA REGULATION
By agreeing to receive our SMS – Text Messaging Service, you accept the conditions of collection, processing and storage of your data – telephone number, regulated by the General Data Protection Law – LGPD (Law n.º 13.709 of 2018). However, you may at any time REVOKE your consent regarding the treatment and storage of data by sending a message to the electronic address [email protected] .
APPLICABLE LAW
The legislation applicable in this contract will be the one that fits and is in force in Brazil, in conflicts between the USER and the Info-products portal (ECO – Eco Finança), Law n.º 9.307 of 1996 – Arbitration , will follow the order of preference safeguarding the provisions of Law No. 8078 of 1990 – Consumer Protection Code.
FORUM
In case of refusal in the composition of the Arbitration for the resolution of conflicts with the USER, the forum to settle any judicial conflicts will be the city of Belo Horizonte – MG.
